The motion. On December 19, 2025, Matthew Barkohanai, as trustee of the Second Amended and Restated George Saadian Revocable Living Trust, filed a motion asking the court to order Bobby B. Saadian, a nonparty witness, to comply with a deposition subpoena. According to the motion, the subpoena was issued on October 9, 2025, personally served on October 12, 2025, and set the deposition for November 7, 2025. Saadian served written objections on October 31, 2025 and did not appear. The motion asks the court to order him to appear, testify, and produce the documents described in Demand No. 1, and to award $500 in contempt sanctions under Code of Civil Procedure section 1992 plus $4,410 in fees and costs, a total of $4,910.
The opposition and reply. Saadian filed an opposition on August 14, 2026, with his own declaration and a declaration of his counsel. The opposition argues that he has no involvement with the trust and no relevant knowledge or documents, that the Trustee did not satisfy the meet-and-confer requirement or provide a code-compliant separate statement, and that the subpoena’s document requests are overbroad and burdensome as directed to a nonparty. The Trustee filed a reply on August 19, 2026.
Why the hearing was reset. The motion was originally set for hearing on August 27, 2026, in Department 9. On that date the court found that the Probate Clerk’s Office had not calendared the motion. The court restored it to the calendar and set it for hearing on November 16, 2026, at 9:30 a.m. in Department 244. No party appeared, and the court directed the clerk to give notice of the order.
What the November 16, 2026 hearing will decide. The hearing will take up the motion to compel: whether Saadian must sit for the deposition and produce the requested documents, and whether the requested sanctions are awarded. The same hearing date also carries the trust petition described below.
The Jonah Saadian petition. The underlying proceeding, LASC Case No. 23STPB12471, is a probate matter concerning the George Saadian Revocable Living Trust, in which Jonah Saadian is the petitioner and Matthew Barkohanai, as trustee, is the respondent. The minute order also continues to November 16, 2026 a petition filed by Jonah Saadian on June 12, 2025 under Probate Code section 17200, identified on the docket as a subsequent petition. The filings on this site describe Jonah Saadian’s petition as seeking the Trustee’s removal and surcharge; the deposition subpoena to Bobby Saadian was issued in that proceeding.
